small.email is designed for creators, solopreneurs, and small brands to exchange genuine person-to-person and transactional messages. We treat your privacy with extreme care and do not serve ads. In return, we require all users to maintain high email sending standards: sending spam, bought marketing lists, or deceptive emails is strictly prohibited and results in immediate account closure.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a binding legal agreement between you ("User", "you", or "your") and small.email ("we", "us", or "our"). By registering an account, configuring your domain DNS records to point to our systems, or accessing any part of our webmail and API services, you agree to be bound by these Terms.
If you are registering on behalf of a company, brand, or organization, you affirm that you have the full legal authority to bind that entity to these Terms.
2. Service Description & Plans
small.email provides white-label custom domain email hosting, responsive webmail software, and developer inbound webhook automation:

3. Domain Ownership & DNS Configuration
To connect custom domains with small.email, you must fulfill the following operational responsibilities:
- Verified Ownership: You must own or be legally authorized to manage DNS records for any domain name you register in your small.email workspace. Ownership is validated via cryptographically unique TXT records.
- White-Label DNS Hygiene: You are responsible for maintaining required MX, CNAME (DKIM signing), and DMARC TXT records provided in your small.email admin console.
- Domain Suspension: We reserve the right to immediately disconnect any domain that fails ownership verification or becomes the target of active security threats.
4. Acceptable Use Policy (AUP) & Strict Anti-Spam
Zero Tolerance for Spam & Bulk Marketing
small.email is exclusively a transactional and conversational email platform. We do not provide bulk marketing newsletter services. Accounts detected sending unsolicited mass emails are suspended immediately without warning or refund.
Strict Prohibitions: You may not use small.email to send, transmit, or distribute:
- Unsolicited commercial email (spam) or messages to purchased, scraped, or third-party email lists.
- Phishing campaigns, credential theft mechanisms, malware, Trojans, or unauthorized tracking software.
- Spoofed sender headers or deceptive sender identity configurations.
- Any material that violates applicable local or international law.
Automated Reputation & Deliverability Thresholds: To safeguard the shared IP reputation of our outbound sending relays (AWS SES EU):
Hard Bounce Limit: ≤ 4%
Domains triggering hard bounce rates exceeding 4.0% will have outbound sending automatically paused pending review.
Spam Complaint Limit: ≤ 0.08%
Domains exceeding 0.08% spam complaints (8 complaints per 10,000 sent) will be suspended immediately to preserve network deliverability.
5. Subscriptions, Fees & Refund Policy
- Annual Billing: Paid plans are billed annually in advance ($9/user/year or localized regional pricing such as Rp120.000/user/year).
- Merchant of Record: For global USD transactions, Polar Software Inc. acts as our official Merchant of Record, collecting and remitting applicable international sales tax, VAT, and GST. Indonesian Rupiah transactions are processed via licensed gateways (Mayar).
- Automatic Renewals: Subscriptions automatically renew at the conclusion of each billing term unless cancelled in workspace settings prior to renewal.
- 14-Day Money-Back Guarantee: First-time annual subscriptions are eligible for a 100% refund within 14 calendar days of initial payment upon request to [email protected]. Accounts terminated due to spam or AUP violations forfeit all refund rights.
6. Mailbox Privacy & Data Security
Your privacy is central to our business model. As outlined in our Privacy Policy:
- All primary servers, databases, and message storage are hosted within the European Union (Germany and Finland) under GDPR compliance.
- We never read, analyze, or process your email content for advertising, commercial telemetry, or behavioral profiling.
- You retain full ownership and intellectual property rights over all emails, documents, and data processed through your account.
7. Service Availability & SLA Disclaimer
We deploy high-availability redundant architectures across Cloudflare edge workers and multiple EU datacenters (Frankfurt & Helsinki). However, email is an asynchronous internet protocol dependent on external mail transfer agents outside our direct administrative control.
The service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose or non-infringement.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall small.email, its founders, affiliates, or licensors be liable for any indirect, consequential, punitive, exemplary, or special damages, or any loss of profits, revenue, or business data resulting from your use of or inability to access the service.
Our aggregate liability for all claims related to the service shall not exceed the total amount paid by you to small.email in the preceding twelve (12) months.
9. Termination & Account Closure
You may cancel your subscription and close your account at any time through the workspace settings. Upon cancellation, your access remains valid until the end of the paid term, after which all mailboxes and associated storage will be permanently wiped in accordance with our data retention schedule.
We reserve the right to suspend or terminate accounts that breach these Terms, conduct fraud, or jeopardize network safety without prior notice.
10. Governing Law
These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with applicable EU laws and international commercial principles, without regard to conflicts of law provisions.
